Terms & Conditions
Effective from: 2 November 2026
This is a translation for convenience; the Czech version is binding.
1. Seller
RECONSYS s.r.o., registered office Železnohorská 810, 583 01 Chotěboř, Czech Republic, company ID 02718120, VAT ID CZ02718120, registered in the Commercial Register of the Regional Court in Hradec Králové, section C, file 54781. Contact: info@gardenauts.cz, +420 731 404 052.
These terms govern the sale of Gardenauts microgreens. The buyer is a consumer or a business; the provisions on consumer rights apply to consumers only.
2. Enquiry, offer and conclusion of the contract
The contact form, an email or a phone call with an enquiry are not a binding order. Sending them creates no contract and no obligation to pay.
Based on your enquiry, we will send you an offer by email or phone: the specific microgreen varieties, the quantity or pack size, the total price including VAT, any delivery charge, the payment method, and the delivery date and place. You will receive a link to these terms and information on storing and using the goods no later than with the offer.
The contract is concluded when we receive your acceptance of the offer. An automatic or other confirmation that we have received your enquiry does not in itself conclude a contract. If we propose a change to the goods, price or date, this is a new offer that requires your acceptance.
If we contact a consumer by phone and make an offer during the call, we will confirm it in text form without undue delay. The consumer is bound by it only after subsequently accepting it electronically or by signature.
After the contract is concluded, we will confirm it in text form, for example by email, together with the text of these terms.
3. Changing and cancelling an order
You may change or cancel a one-off order free of charge by email or phone until 23:59 on the third calendar day before the agreed delivery day. For example, for a Friday delivery you can cancel free of charge until 23:59 on Tuesday. After that, a change or cancellation is possible only by agreement, because the goods may already have been harvested; otherwise the order remains binding. This does not affect your rights in respect of defective goods.
4. Price and payment
Prices for consumers are final and include VAT. The price excluding VAT is shown for the information of businesses. You can pay by bank transfer against an invoice due within 14 days of its issue, or in cash to the driver on delivery.
5. Delivery
We deliver on the routes and days published on the website. Delivery on these routes is included in the price. Delivery elsewhere is possible only by agreement, and we will state any charge in the offer. If you cannot be reached at delivery, we will arrange a handover or a new date with you.
We will make the mandatory information about the specific food available to you before the contract is concluded, at the latest in the offer, except for information that the law allows to be provided only on delivery. On delivery, you will receive all mandatory information, including storage and use instructions. We will change the agreed composition or quantity only by agreement with you.
6. Standing orders
When arranging a standing order, we agree the content and quantity of each delivery, the frequency, the first date, the final price of each delivery including VAT and any delivery charge, and the billing method. No further order is needed for the individual agreed deliveries.
A standing order is for an indefinite period. You may end or pause it without penalty by email or phone. Notice received by 23:59 on the third calendar day before the next delivery takes effect from that delivery. With later notice, the next delivery remains agreed and the change takes effect from the following delivery. When pausing, we will agree the date or method of resuming.
If a standing order is discounted, the offer states the discount or the resulting price per delivery. The discount applies for as long as the standing order lasts.
7. Withdrawal from the contract
Fresh microgreens are goods liable to deteriorate rapidly. Under Section 1837(e) of the Czech Civil Code, a consumer therefore has no right to withdraw without giving a reason within 14 days. This does not affect your rights in respect of defective goods, other statutory rights of withdrawal, or the option to cancel an order or end a standing order under Articles 3 and 6.
8. Defects and complaints
We are liable to consumers for the goods being free of defects on delivery, in particular for matching the agreed type, quantity and quality and being fit for ordinary use.
If the goods are defective, you may request that the defect be remedied by delivering new goods or by repair, unless the chosen method is impossible or disproportionately costly. Repair is generally not an option for fresh microgreens. Under the conditions of Section 2171 of the Civil Code, you may request a reasonable discount or withdraw from the contract, in particular if we refuse to remedy the defect or fail to remedy it within a reasonable time and without significant difficulty, if the defect recurs, or if it is a material breach of contract. You cannot withdraw for an insignificant defect.
A consumer may raise a defect that appears within two years of delivery. This period is not a guarantee of a two-year shelf life for food. If a defect appears within one year of delivery, it is presumed to have existed at delivery, unless the nature of the goods or the defect rules this out.
Please check the goods on delivery and tell us about any defect as soon as possible, ideally on the day of delivery and with a photo. This makes it easier to assess; not doing so does not in itself end your rights. We are not liable for defects caused by the buyer, for example through unsuitable storage, or for natural deterioration consistent with the nature and use-by period of the goods. This does not affect rights relating to a defect that existed at delivery.
You may make a complaint by email at info@gardenauts.cz or by phone at +420 731 404 052. This does not affect other statutory ways of making a complaint. When you make a complaint, we will give you a written confirmation of its date, its content, the outcome you request and the contact for notifying you of the result.
We will resolve a complaint, including remedying the defect, without undue delay given the nature of fresh goods, and no later than 30 days after it is made, and will inform you of the result within that period. A longer period may be agreed only individually. We will also confirm the date and method of resolution or give written reasons for rejection. If the period expires without resolution, you may withdraw from the contract or request a reasonable discount.
Purchases by businesses are governed by the general provisions of the Civil Code on sale.
9. Out-of-court dispute resolution and supervision
A consumer may turn to the Czech Trade Inspection Authority for out-of-court resolution of a dispute arising from a sales contract. Information and the procedure for filing are at https://coi.gov.cz/informace-o-adr/. Out-of-court resolution aims at agreement between the parties and does not prevent you from going to court.
Supervision is carried out by the competent authorities within their statutory remit, in particular the Czech Trade Inspection Authority and, for food, the Czech Agriculture and Food Inspection Authority.
10. Final provisions
The contract is governed by Czech law and is concluded in Czech. We process personal data in accordance with our Privacy Policy.
The contract is governed by the terms the buyer was made aware of before it was concluded. Publishing a new version does not in itself change existing contracts, including standing orders. We will agree any change to the price or other conditions of a standing order with the buyer before it applies.
